Today, history was made. Federal Judge Joseph Tauro ruled the Defense of Marriage Act (DOMA) passed by Congress in 1996, unconstitutional.

In two separate challenges, Judge Tauro ruled that Congress violated the Tenth Amendment by passing DOMA, taking marriage decisions away from states and violating equal protection principles embodied in the Due Process Clause of the Fifth Amendment.

According to court documents, Congress created DOMA for the purposes of "defending and nurturing the institution of traditional heterosexual marriage" and "defending traditional notions of morality."

The court clearly recognized the discriminatory language used by members of Congress in their efforts to define marriage based on their religion and their own definition of what is moral instead of the Constitution.

The magnitude of Judge Tauro¹s ruling cannot be underscored. His rulings have a direct and important impact on the lives of millions of gay people in every state in the nation. DOMA restricted spouses in legal same-sex marriages from being eligible for more than 1,000 federal benefits, including Medicare, Medicaid, health insurance for spouses in same-sex marriages, Veteran¹s administration benefits and so many more.

Additionally, with today¹s ruling, Judge Tauro stated that DOMA exceeded the scope of federal power. As we move forward, his ruling will be important as we witness the use of Congressional power in the months and years to come.
